Booking Terms and Conditions
1. Agreement
1.1 These terms and conditions form the basis of the agreement between you and Nerja Beach Holidays (representing the property owner) for the holiday rental of their property together with all other conditions set out.

1.2 By signing the Booking Form you agree that you are over 18 years of age and that you accept full responsibility for all payments due and for the consequences of any actions of all persons who will use the Property during your holiday.

1.3 As a legal requirement, Passport and other details of ALL guests (including children) must be submitted to the authorities in Spain prior to you taking up residence in your holiday rental property. The process is exactly the same as the check in service at a hotel.
Please look out for an email from info@villacheckin.com prior to your arrival. They will provide a link for you to register everyone. This link can be sent to other guests in your group for completion. 2. Booking
2.1 Nerja Beach Holidays will confirm the booking on receipt of the deposit of 40% of the holiday rental fee.

2.2 Payment can be made via debit or credit card. There is a standard fee of 5% on all transactions by debit or credit card.
Payment can be made by bank transfer. For countries outside the European Union, a standard bank transfer fee of 5% will be applicable.

2.3 Once Nerja Beach Holidays has received your booking form and the Deposit for the accommodation, then an agreement exists between us and the client.
​
2.4 If the holiday is due to start within 8 weeks of the date of booking the total of the holiday rental fee is payable at the time of booking.

3. Final Payment
3.1 The balance of the holiday rental fee less any Deposit will become due 8 weeks before the start of the holiday. If the balance is not received on time, Nerja Beach Holidays reserves the right to cancel your booking and retain the Deposit.

4. Cancellation
4.1 You may cancel your booking at any time provided you do so in writing to Nerja Beach Holidays but you will remain liable for the full balance of the holiday rental fee. Nerja Beach Holidays will seek to re-let the Property for all or part of the booking period and, if successfully, will refund the money paid by you less an administration charge of 50€.

4.2 Nerja Beach Holidays reserves the right to re-let at a discount or for a shorter period in which case we will pay the refund or a proportion of it if the Property is re-let for a shorter period, less the discount and an administration charge of 50€.

4.3 Nerja Beach Holidays does not operate any scheme of cancellation or travel insurance and you should obtain your own insurance cover for the holiday.

4.4 Nerja Beach Holidays reserves the right to cancel the booking at any time in the event or circumstances beyond the reasonable control of Nerja Beach Holidays, or if in the reasonable opinion of Nerja Beach Holidays it is necessary to undertake essential works at the Property. In these unlikely circumstances Nerja Beach Holidays will endeavour to offer a suitable alternative. If no such alternative holiday is agreed between yourselves and us, Nerja Beach Holidays will refund in full all money received for the booking. Nerja Beach Holidays will not otherwise be liable for any loss incurred by you as a result of the cancellation.

5. Change of Booking
5.1 Nerja Beach Holidays will endeavour to assist you in a transfer of a booking to an alternative property or an alternative date at your request and an administrative charge of 50€ will be made in such a case in addition to any increased rent due on the alternative property.

5.2 Changes cannot be accepted within one month of the start date of the holiday. If a change results in a reduction in the length of the holiday it will be regarded as a cancellation.

6. Occupation of the Property
6.1 The number of people staying in the Property must not exceed the maximum number stated in the Booking Form.
6.2 You must not use the Property for any activity or in such a way as to cause nuisance or annoyance to neighbours.
6.3 You and your guests must comply with any reasonable regulations relating to the Property, or the site within which the Property is situated.

7. Your Obligations
7.1 You agree to keep the Property and its contents in the same condition and repair as on your arrival at the Property and to pay to Nerja Beach Holidays upon written demand any costs incurred in making good any loss or damage to the Property or its contents caused by your action or omission or that of any guest accompanying you.

7.2 No pets are permitted at the Property unless otherwise agreed beforehand with Nerja Beach Holidays.

7.3 You must allow anyone authorised by Nerja Beach Holidays to enter the Property during the holiday. Nerja Beach Holidays will endeavour to give you reasonable notice of such a visit except in an emergency when immediate access must be allowed.

7.4 You must ensure that the Property is left in a satisfactory condition upon your departure at the end of your holiday. Nerja Beach Holidays may make a charge for any additional cleaning if this is considered necessary.

Security Deposit
7.5 Guests are required to provide a security deposit to cover potential breakages, damages, or theft during their stay. This security deposit will be held by Nerja Beach Holidays and will be fully refunded within 72 hours after departure, provided that the property is left in a satisfactory condition, and no incidents of breakages, damages, theft, or excessive cleaning have occurred.

In the event of reported damage from the owner/agent/end of holiday inspection, Nerja Beach Holidays reserve the right to deduct any costs incurred from the clients security deposit. Any breakages or damages should be reported to Nerja Beach Holidays at the time they occur to allow time to investigate prior to deducting from the clients security deposit. If the client does not inform Nerja Beach Holidays of any damages then the owner/agents claim is binding. You will be notified of any breakages or damages recorded after your departure and charged for accordingly.

7.6 Guests are expected to leave the property in a respectful and clean condition. In the event that excessive cleaning is required due to the property being left in a disrespectful state, a cleaning fee will be charged to the guest.
7.7 Furnitures arrangements: Guests are welcome to rearrange furniture within the property for their comfort, but all furniture must be returned to its original placement before check-out. Any damages or additional cleaning required due to furniture being left out of place will result in a fee charged to the guest.

8. Nerja Beach Holidays Right to Refuse/Terminate
8.1 Nerja Beach Holidays reserves the right to refuse any booking.
8.2 Nerja Beach Holidays reserves the right to terminate this Agreement and ask you and your guests to leave immediately if this is deemed necessary by Nerja Beach Holidays as a result of your behaviour or that of your guests or any other material breach by you of the terms of this Agreement.

9. Arrival and Departure
9.1 The holiday rental period begins at 15h00 on the first day of the booking period and ends at 10h00 on the day of the departure. If your stay extends beyond this period you may be subject to a charge for the additional time period.

10. Description and Facilities
10.1 Nerja Beach Holidays will endeavour to inform you at the time of booking of any changes to our web site description of the Property or of any events which may be taking place near the Property during your holiday. Nerja Beach Holidays does not accept any liability for any works or activity of any sort occurring on its premises adjoining or neighbouring the Property.

11. Tenancy
11.1 This Agreement is for the purposes of a holiday rental only and does not create the relationship of Landlord and Tenant between you and the Property Owner. You will not be entitled to a tenancy or to any other form of statutory security of tenure as a result of this Agreement.

12. Complaint
12.1 If you have any cause for complaint during your holiday at the Property please notify Nerja Beach Holidays who will make all reasonable efforts to assist and resolve the issue. Nerja Beach Holidays will not normally make any refund or recompense in respect of a complaint made after departure if the complaint was not made known to Nerja Beach Holidays during the holiday rental period. Complaints forms are supplied by Nerja Beach Holidays and can be provided upon request.

13. Lost Property
13.1 Nerja Beach Holidays shall not be responsible for loss or damage to any of your belongings or for any injuries sustained by you or any of your guests unless caused by negligence or default of Nerja Beach Holidays.

14. Data Protection
14.1 All personal data proved to Nerja Beach Holidays will be held and processed in accordance with the requirements of the Data Protection Act and current Spanish Laws. We will keep your personal data safe and secure. We will not share your personal details with other organisations without your knowledge and consent, unless required by law to do so.
PAYMENT TO NERJA BEACH HOLIDAYS WILL FORM THE AGREEMENT OF THE BOOKING FOR WHICH THESE TERMS AND CONDITIONS WILL APPLY AND BE LEGALLY BINDING.
